1. ACCEPTABLE USE
800Link, Inc. provides voice mail service for whatever lawful use its Customer sees fit.
800Link will use its best efforts to maintain the confidentiality of its Customer and will not
use Customer information for its own gain. Any use of the services provided by 800Link that is
in violation of any applicable law or regulation may result in the immediate termination of
service and loss of confidentiality.
All 800Link services are offered on a pre-paid basis. 800Link requires a one time pre-payment
at the time of service activation. After the initial pre-payment is exhausted, additional
payments will be charged automatically to the initial method of payment unless alternate
payment arrangements have been made with 800Link. Accounts falling below a positive balance are
subject to service interruption. Charges may include monthly fees, monthly minimum usage
requirements and usage charges, depending upon the services provided to Customer.
3. CANCELLATION / REFUND POLICY
Services are provided on a month-to-month basis and may be cancelled in writing at any time. If
service is cancelled within fourteen days of activation, the initial pre-payment, less any
usage charges, will be refunded to Customer. If service is cancelled more than fourteen days
after activation, any funds remaining from payments in excess of the initial pre-payment after
all charges have been satisfied will be refunded to Customer. Applicable monthly fees and usage
requirements will be prorated with respect to the actual time in service.
4. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
800Link will use reasonable efforts to provide the services specified herein, but makes no
warranty of any kind, whether expressed or implied, for the service it provides. 800Link
disclaims any warranty of merchantability or fitness for a particular purpose. The liability of
800Link or it's agents, for damages arising out of interruptions, delays, errors, loss of data
or defects in transmission occurring in the course of furnishing service, and not caused by the
negligence of the Customer, commences upon activation of service and in no event exceeds an
amount equivalent to the proportionate charge to the Customer for the period of service, during
which, such interruptions, delays, errors, loss of data or defects in transmission occur.
800Link is not liable for any act or omission of any other company or companies furnishing a
portion of the service, including delays or interruptions in the provisioning of service.
5. MODIFICATION OF SERVICE
800Link reserves the right to eliminate and/or modify service offerings upon not less than
thirty days prior notice to Customer.
6. GOVERNING LAW
The parties agree to submit to the Courts of Illinois only, any dispute arising out of this
Agreement or related thereto, and consent to the jurisdiction of said Courts and further agree
that any and all matters of dispute shall be adjudicated, governed and controlled under and by
7. ENTIRE AGREEMENT
This agreement represents the entire understanding between the parties. There are no
representations, warranties, agreements or understandings, oral or written, between the parties
not fully expressed herein.
